"the challenge"


By entering the TNM Smart App Challenge (herein referred to as "the Challenge"), you agree to be bound by the Terms and Conditions outlined below.
Promotional materials relating to the Challenge, including all information on how to enter and participate in the Challenge, also form part of these Terms and Conditions. In the event of any conflict between terms referred to in such promotional materials and these Terms and Conditions, these Terms and Conditions will take precedence.
1.         The promoter of the Challenge is Telekom Networks Malawi Limited (TNM) whose address is Glyn Jones Road, Livingstone Towers, P.O. Box 3039, Blantyre, Malawi.
2.         The Challenge commences at 00:00 hours on Monday 5th October  September 2015 and application development submissions will close at 23:59 hours on 30th November 2015. All entries must be received by 23.59hours on Monday 30th November 2015.
3.         The Challenge will only be open to full time students resident in Malawi who will use mobile technology to develop solutions that will make an economic and social impact on Malawi.
4.         Mobile solutions are defined as solutions that incorporate the use of mobile technology for development. Developers must ensure that their solutions are scalable and have potential for growth. These solutions may incorporate other technology but participants must ensure that a mobile component is present. This may be in the form of native applications, use of SMS or USSD or Data.
5.         In order to be eligible to for the Challenge, participants must be Malawian citizens above thirteen (13) years of age for the Smart Student category and between 5-12 years of age for the Smart Kid competition category. Participants for the Smart Student challenge must enter the Challenge in groups of a maximum of three (3) members. Members of the group should possess diverse skills in business development and technical development, finance, marketing and so forth.  Participants for the Smart Kid challenge must enter as individuals. Employees of TNM or any of its subsidiary or affiliated companies and anyone otherwise connected with the operation or fulfilment of the Challenge are not eligible to take part. TNM reserves the right to require participants to prove that they are eligible. If the winner of any of the prizes is found to be ineligible, TNM reserves the right to award the prize to another participant.
6.         The Challenge will operate on the website at the following URL address: www.smartchallenge.tnm.co.mw (herein referred to as ‘the Website’). To enter the Challenge, a registration form must be completed and these terms and conditions must be accepted. Détails on how to submit an entry can be found on the Website. The entry must include a description of how the solution or application works and the presumed benefits for the applicable category listed in Section 7 below.
7.         Only one application may be submitted to the Challenge. Each application must demonstrate the following:

    1. A team profile clearly outlining the different roles and responsibilities of the team members for the Smart Student category. The team profile should clearly exhibit a multi-disciplinary team able to manage business, project and application development. For the Smart Kid category, a profile of the individual making the submission will be required.
    2. Business need/problem statement.
    3. Proposed solution.
    4. Business model including market significance, customer base, market size and commercialization.
    5. Demonstrate financial sustainability and long term future plan for the application/solution.
    6. Impact on the customer base from a commercial and usage perspective.
    7. Competition in the market and competitive advantage of the solution over others in the market.
    8. Go-to-market strategy once application is ready for launch.
    9. Video presentation (about five (5) minutes long). This is a key requirement in the first stage of the challenge.

8.         Entry into the competition will be through 3 main categories as follows: -

    1. Smart Kid 
      1. Entry into the TNM Smart Kid competition will be restricted to children between 5-12 years of age. Participants will be allowed to get assistance from their parents/guardians to register and make a submission online.
      2. Children will be required to have parental consent to participate in the competition. Proof of parental consent will be required before collection of reward.
      3. Participants will play USSD based games and will be assigned scores based on their performance. The child with the highest score at the end of the month will win Haus P7 Tablet.
      4. Participants will be required to submit their scores online and only participants whose scores have been submitted will be eligible. Incorrect submission of scores will lead to automatic disqualification.
      5. Children that develop applications will be required to submit their application submission through a video and the public will vote for the top 5 applications. Competitors will be required to provide a link where the application can be accessed or downloaded by the public during the voting period. A panel of judges will select the final winner at the end of the competition. The final winner will win an IPAD Mini 2 and sponsored trip to Silicon Valley to visit Facebook, Google, Apple, Opera Software and Stanford University
      6. A monthly winner will be selected every month throughout the competition period – 4 monthly winners in total by end of the competition.
    2. Smart Student 
      1. Participation in the TNM Smart Student competition will be limited to students in training at schools in Malawi at the time of the competition – be it primary, secondary or tertiary level. Participants will be required to provide evidence of their school of affiliation. Students will be required to provide these details – School Name, Student ID, Age etc. – during registration. For the finalists, schools will be involved in the student verification process.
      2. Participants will be required to enter the competition as a team of not more than 3 students. The members of the group may be from the same school or from different schools. Team work will be encouraged for application development and skill set distribution in order to help them better manage their businesses. Members of the team will not be required to all be mobile app developers and from the same school i.e. students from different schools and with different skill sets could form a team.
      3. Participants will be required to submit a video recording of a presentation of their business idea, the application and the public will vote for the best idea. Participants will also be required to provide a link where the application can be accessed or downloaded by the public during the voting period. The top 5 Applications with the highest number of votes will be reviewed by a panel of judges at the end of the competition who will select the final winner.
      4. The winning application will go into full incubation period before the commercial launch of the product.
    3. Smart Community
      1. Participation in the Smart Community challenge category will be open to accredited colleges and technology hubs in Malawi. This category is aimed at identifying and supporting serious application developer communities capable of offering solutions through the mobile ICT industry. These communities will be expected to encourage team work in application development and skill set distribution. Contestants will be required to submit a video recording of a presentation of the best apps – at most 5 of them– that have been developed within their community. Contestants will be required to provide a link where the application can be accessed or downloaded by the public during the voting period.
      2. The public will vote for best app development community and the community with the highest number of votes will win.

9.         Selection of the winners of the Challenge will take place in 3 stages:
9.1      Stage 1: Public Voting: 1st Feb to 21st Feb, 2016.
9.1.1    Participants in the application development competition will only be allowed to make one submission. Submissions will be through a video recording demonstrating the use and the applicability of the app. Viewers will be able to download the application from the competition portal.
9.1.2    Applications will be judged based on application, relevance, aesthetic appeal, design, usability, commercial viability and social impact.
9.1.3    The public will vote for the best app as well as the best app development community through the competition portal and SMS short code 575 by sending the name of their chosen team or community.
9.2       Stage 2: Shortlisting Process: 22nd Feb to 28th Feb, 2016
After completion of the public voting TNM will select 5 submissions with the most votes in each category. Each individual member of the shortlisted teams and individuals (herein referred to as “a Finalist”) will be required to execute and return to TNM a signed agreement form (herein referred to as “Terms of Incubation”). The Terms of Incubation forms must be signed by the finalist and returned to TNM after the announcement of the finalist by the 11th of January 2016 .These will relate to the conduct of the Finalist during the incubation period. If a Finalist fails to return the Terms of Incubation by this date, the applicant risks being disqualified as a finalist and an alternative finalist may be selected.
            9.3       Stage 3 –Special Incubation Period: 8th March 2016
Teams and individuals successful in Stage 1 will be invited to participate in the special incubation phase of the Challenge. During this phase the successful groups would be nurtured in business development skills, technology solutions training, product development and will have an opportunity to receive mentorship and engage with various experts from the industry. These groups will be notified by phone or email .The final incubation sessions will be held at TNM Head Office, Living Towers, Blantyre or such other venue as may be communicated by TNM to the qualifying teams and individuals
 9.4      Stage 4 -Demo Stage & Awards: 11th Mar, 2016
9.4.1    Teams will be invited to make a ten (10) minute presentation on the application they have developed.
9.4.2    A panel of judges will select the top solution in each category, the runner up and the overall grand winner. Criteria for selection of the winning solution will be weighted as follows:
9.3.2.1 Significance of the solution (economic and social impact) -25%.
9.3.2.2 Use of mobile technology-20%.
9.4.2.3 Novelty and uniqueness of the solution-10%.
9.4.2.4 Project Structure/Business Plan-10%.
9.4.2.5 Team structure and skills-15%
10.       Awards will be allocated as follows:

    • Smart Kid 
      1. Smart App Developer to get a high-end tablet - iPad Mini 2 and Trip to Silicon Valley to visit Facebook, Google, Apple, Opera Software and Stanford University among others.
      2. Top 5 App developers will receive Facebook Bootstrap packages which provides startups with an exclusive community, worldwide events, mentorship from Facebook, and up to US$30,000 in free developer tools per package. These developers’ tools are to be used with their colleagues at their school of affiliation
      3. 4 Monthly winners to get a Haus P7 each.
      4. Facebook & Opera  branded merchandize like T-shirts for each of the winners
    •  Smart Student 
      1. Trip to Silicon Valley  to visit Facebook, Google, Apple, Opera Software and Stanford University among others.
      2. Top 5 App developers will receive Facebook Bootstrap packages which provides startups with an exclusive community, worldwide events, mentorship from Facebook, and up to US$30,000 in free developer tools per package. These developers’ tools are to be used with their colleagues at their school of affiliation
      3. Top 3 winners to be integrated with Free Basics by Facebook Malawi i.e. their applications will be integrated into Free Basics by Facebook Malawi.
      4. Each member of the winning team to get Samsung S6 Edge.
      5. Facebook & Opera branded merchandize like T-shirts for each of the winners
    • Smart Community  
      1. Winning institution will WIN a TNM Computer Lab with 4 computers. The lab to be branded as TNM Innovation Lab.
      2. Top 5 App developers will receive Facebook Bootstrap packages which provides startups with an exclusive community, worldwide events, mentorship from Facebook, and up to US$30,000 in free developer tools per package. These developers’ tools are to be used with their colleagues at their school of affiliation
      3. Facebook & Opera branded merchandize like T-shirts for each of the winners

11.       Communication and queries regarding the Challenge will be sent to and answered by TNM through the email –This email address is being protected from spambots. You need JavaScript enabled to view it.
12.       Teams and individuals that win the awards may be required to submit valid identification documents and proof of their affiliation to schools or communities before receiving their award. TNM bears no responsibility whatsoever for any loss incurred as the result of winning these awards. The teams and members of winning teams agree to indemnify and hold TNM harmless from any loss or damage occasioned from the foregoing (including reasonable legal expenses).
13.       The winners are individually responsible for any personal or incidental expenses incurred in claiming or using the prizes. The prizes are as stated and are non-exchangeable and non-transferable. There will be no alternative to the prizes in part or in whole. By participating in the Challenge, participants agree that the prizes are awarded on an "as is" basis, and that neither TNM nor any of its subsidiary or affiliated companies, make any representations or warranties of any nature with respect to the prizes.
14.       TNM will collect and process participants' personal information in order to conduct the Challenge and this may be shared with TNM's agents to the extent necessary for the award to be delivered to the winner. Names and other personal details provided at entry into the Challenge will be collected and stored by TNM.
15.       TNM reserves the right to modify, cancel, terminate or suspend the Challenge in whole or in part, at its sole discretion, if it believes the Challenge is not capable of being conducted as specified within these Terms and Conditions or in the event of a virus, computer bug or unauthorized human intervention or any other cause that is beyond the reasonable control of TNM that could corrupt or affect the administration, security, impartiality or normal course of the Challenge. TNM and any of its subsidiary or affiliated companies will not be responsible for any condition, circumstances, losses, failures or delays caused by events beyond its or their control such as (but not limited to) the acts or defaults of any subcontractors or agents or otherwise that may cause the Challenge to be disrupted or corrupted, or that may lead to loss or damage of grants in transit to the winner.
16.       SAVE WHERE IT HAS BEEN NEGLIGENT, TNM WILL NOT BE RESPONSIBLE FOR ANY DAMAGE, LOSS OR INJURY RESULTING FROM PARTICIPANTS' ENTRY INTO THE CHALLENGE OR THEIR ACCEPTANCE AND/OR USE OF THE PRIZES, OR FOR TECHNICAL, HARDWARE OR SOFTWARE FAILURES, LOST, FAULTY OR UNAVAILABLE NETWORK CONNECTIONS OR DIFFICULTIES OF ANY KIND THAT MAY LIMIT OR PROHIBIT THEIR ABILITY TO PARTICIPATE IN THE CHALLENGE. TNM WILL NOT BE RESPONSIBLE FOR ANY LOST, DAMAGED, DEFACED, INCOMPLETE, ILLEGIBLE OR OTHERWISE UNREADABLE ENTRIES OR FOR ANY INDIRECT OR CONSEQUENTIAL LOSSES.
17.       PARTICIPANTS OF THE CHALLENGE ACCEPT THAT THE SOLUTIONS SUBMITTED ARE THEIR OWN AND THEY AGREE TO INDEMNIFY TNM FROM ANY THIRD PARTY LIABILITY OR CLAIMS THAT ARISE FROM THE SUBMITTED SOLUTIONS. IN ADDITION ALL PARTICANTS ACCEPT THAT ALL APPLICATIONS SUBMITTED THROUGH THE CHALLENGE WILL FIRST BE LAUNCHED ON THE TNM APP STORE BEFORE BEING LAUNCHED ON ANY OTHER APP STORES.
18.       Any illegible, incomplete or fraudulent entries will be rejected. Any participant who enters or attempts to enter the Challenge in a manner, which in TNM's reasonable determination is contrary to these Terms and Conditions or by its nature is unjust to other participants (including and without limitation to tampering with the operation of the Challenge, cheating, hacking, deception or any other unfair playing practices such as intending to annoy, abuse, threaten or harass any other participants or and/or any of its agents or representatives) may be rejected from the Challenge at TNM's sole discretion. Furthermore, where such actions have significantly impaired the Challenge, TNM may, at its sole discretion, add further stages to the Challenge as it deems reasonably necessary in order to resolve any problems arising as a result of such actions.
19.       By participating in the Challenge, you agree to release and hold TNM, its subsidiaries and affiliated companies, together with their respective employees, officers, directors, agents and representatives, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with participating in the Challenge or resulting from your acceptance or use of the prizes..
20.       All decisions made by TNM in relation to the Challenge are final in all matters. Any disputes that may arise from the Challenge will be settled amicably failure of which within thirty (30) days of notification of such dispute, then either party may refer the matter for arbitration to an Arbitrator appointed on agreement or by the President of Malawi Law Society if parties fail to agree on the appointment. To the furthest extent permissible in law the decision of the arbitrator shall be binding and final between the parties.
21.       These Terms and Conditions are governed by the Laws of Malawi.
